CALN – The board of commissioners voted to authorize the execution of the termination agreement with former Police Chief Brian R. Byerly at their meeting, Thursday.
“Tonight’s agreement was approved at the direction of our legal counsel and, when executed, will complete the termination process with Brian Byerly,” said board President Vincent Rose.
The motion was put forward by board Vice President Charles Kramer and did not appear on the meeting agenda. The motion was unanimously approved, though the board was unable to provide any details on the agreement.
“This is a personnel matter and we cannot comment on it at this time,” said Kramer.
Byerly was placed on paid administrative leave last month after allegations of misconduct. At a special meeting on Sept. 6, Byerly was terminated from the position; Lt. Jeff Nash currently supervises the department.
It was expected that Byerly would appeal his ouster, but Rose commented that further legal actions were not likely to be taken by either the township or Byerly.
“The proposed civil service process will be terminated and no further actions are anticipated by either party,” said Rose. “The board of commissioners will have no further comment in regard to this matter.”
When asked if the agreement was a buyout, Rose commented that the board could not disclose any details on the agreement because it had not been signed or executed yet.
Byerly’s attorney did not return repeated phone calls seeking comment.
Prior to his termination, Byerly had served as police chief for four years and had been a member of the department for 26 years.
